2. The petitioner seeks regular bail in connection with Nokha P.S. Case No. 188 of 2018 registered for the offence under Sections 302, 201/34 of the Indian Penal Code read with Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner is alleged to have participated in the killing of the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that due to land dispute the father and brother of the petitioner have been killed by the prosecution side and in the present case the petitioner has falsely been implicated. The
Patna High Court CR. MISC. No.24048 of 2025(4) dt.01-09-2025 2/2 petitioner is in custody since 23.02.2024.
5. Learned A.P.P. appearing for the State and learned counsel for the informant have vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case as well as the period of custody and the delay in the trial, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Rohtas at Sasaram/concerned Court below in connection with Nokha P.S. Case No. 188 of 2018.
