The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy.

Heard learned counsel for the petitioner and learned APP for the State.

At the outset, learned counsel for the petitioner submits that inadvertently, in the first paragraph of the main petition, Section 307 of the Indian Penal Code is left to be mentioned. Hence the office is directed to add Section-307 of the Indian Penal Code in paragraph-1 of the main application.

Patna High Court CR. MISC. No.26526 of 2020(2) dt.21-10-2020 2/3 The petitioner is apprehending his arrest in a case registered under Sections 147, 341, 323, 326, 379, 307, 384 & 506 of the Indian Penal Code.

Allegedly, while the informant was going to wage to the labourers, in the way, the accused persons surrounded him and started abusing. On prottest, on the order of Sadanand Yadav, one Shiv Shankar Yadav assaulted the informant on his head as a result of which, the informant sustained bleeding injury. It is also alleged that the money, meant for payment of labourers was snatched away. Firing is also alleged to have been made. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. Though there is allegation of making firing but none is said to have been injured by the petitioner. The petitioner has been made accused in the present case due to political reasons. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of

No.26526 of 2020(2) dt.21-10-2020 3/3 twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Bihar P.S. Case No. 382 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
