Petitioner seeks regular bail in connection with Madhubani Town P.S. Case No. 203 of 2019 corresponding to C.R.I. No. 1018 of 2019 registered for the offence under Section 452, 380 of the I.P.C.
The allegation as per the First Information Report is that the petitioner along with other accused persons after breaking the door of the house of the informant committed theft and took away ornaments worth Rs. 2,46,000/- and Rs. 40,000/- cash.

No.26513 of 2020(6) dt.23-03-2021 2/3 Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of his confessional statement only and no stolen article and / or any other incriminating material has been recovered from the possession of the petitioner. Learned counsel next submits that petitioner is in custody since 16.08.2019.
On the other hand, learned counsel for the State submits that altogether 08 cases are pending against the petitioner and the petitioner is a habitual offender and he has accepted in his confessional statement that he along with others entered into the house of the informant and committed theft. Having regard to the submissions made by learned counsel for the parties and taking into consideration the nature of allegation, I am inclined to grant regular bail to the petitioner after framing of charge.
Accordingly, let the petitioner, above named, be released on regular bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 203 of 2019 corresponding to C.R.I. No. 1018 of 2019.
