SINHA) Date: 06-11-2015 In the light of our earlier order dated 30.09.2015 respondent no. 1 has sent Rs. 1,75,000/-, 1,00,000/- in the Bank account of appellant through RTGS on 03.11.2015 through ICICI Bank, Chapra Branch and Uttar Bihar Gramin Bank, Malbaria Branch, as would appear from the Customer Acknowledgement Receipt issued by both the Branches on 03.11.2015. Counsel for the appellant, however, states that out of the aforesaid two remittances appellant has received only Rs. 1,75,000/-. The remittance of Rs. 1,00,000/- made through Uttar Bihar Gramin Bank, Malbaria Branch has not been credited in her Punjab National Bank account referred to in order no. 12 dated 30.09.2015.
Respondent no. 1 having produced before us the Customer Acknowledgement Receipt in original, we have no reason not to believe the assertion made on his behalf that such remittances have already been made and
Patna High Court MA No.512 of 2011 dt.06-11-2015 accordingly, dispose of the application, however, with liberty to the appellant that if a sum of Rs. 1,00,000/- is not received by her, it shall be open for her to invite the attention of this Court by filing a petition and mentioning before the Bench of which Nilu Agrawal, J is a Member.
