1. Heard learned counsel for the petitioner and learned APP for the State.
2. On query of the Court with regard to the stage of the case, the learned counsel for the petitioner fairly submitted that the stage of the case has changed from the stage of cognizance, charges have been framed.
3. The learned Additional P. P. submits that since charges have been framed which signifies commencement of the trial and it is a case under Section 304(B) of the I.P.C. and petitioner is the husband, as such, the Court, now at this stage, should be reluctant to interfere. It is further submitted that in the event, if the petitioner is innocent, he will get acquitted.
4. Considering the submission made by the learned Additional P. P., the Court is not inclined to entertain the
Patna High Court CR. MISC. No.41334 of 2017(2) dt.31-10-2023 2/2 quashing application.
