The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

It is contended on behalf of the petitioner that from perusal of first information report itself it appears that incised wounds on the informant upon lateral side of eyebrow and right side of lip has been caused by Suresh Yadav, who has assaulted by 'Dabia", and Ram Ashish Yadav assaulted by dagger. Allegation upon the petitioner is that he has assaulted upon nephew of the informant Prakash Mukhia and it would be apparent from the order of the Sessions Judge that he had

Patna High Court Cr.Misc. No.31682 of 2016 (2) dt.02-09-2016 2/2 sustained two injuries caused by hard and blunt substance but are simple in nature. There is also a counter case filed by co-accused Rama Ashish Yadav being Laukahi P.S. Case No. 32/2016 according to which the injuries upon three persons. Having regard to the facts and circumstances, let petitioner Ram Babu Mukhiya be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Laukahi P.S. Case No. 31 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri S.K.Rai, Judicial Magistrate 1st Class, Jhanjharpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
