JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-11-2018 The father of the petitioner died on 04.10.1989. The petitioner was only one-year-old at the time of death of his father. He attained majority 16 years after the death of his father, whereas the time prescribed for application for grant of compassionate appointment is five years.

Compassionate appointment is not a reservation. It is governed by a policy decision and the beneficiary has to apply within the time prescribed for submission of application. Since the petitioner was ineligible for submission of application within

Patna High Court CWJC No.16789 of 2015(2) dt.27-11-2018 2/2 the time frame prescribed, no indulgence can be granted. This Court finds no merit in this application. It is accordingly dismissed.
