The petitioner seeks regular bail in connection with Halsi Police Station Case No. 222 of 2019, registered for the offences punishable under Sections 341/323/307/504/506/ 325/34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner assaulted the informant by means of lathi on his head, causing head injury.
Learned Counsel for the petitioner submits that the parties are co-villagers and the dispute between them had arisen on the point of plucking of vegetables. He further submits that in course of investigation, no injury report has been brought on
Patna High Court CR. MISC. No.26562 of 2020(2) dt.13-10-2020 2/2 record, as mentioned in the First Information Report. However, on perusal of the impugned order, it appears that the informant has filed the injury report, before the learned Sessions Judge, Lakhisarai, showing therein that he has received five multiple injuries, out of which two injuries are grievous in nature, caused on his scalp. He further submits that the petitioner is in custody since 21.10.2019 and charge-sheet has been submitted in this case.
Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner has remained in custody for almost one year, I am inclined to grant regular bail to the petitioner. This application is allowed.
Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Halsi Police Station Case No. 222 of 2019.
