2. The petitioner seeks regular bail in the present case registered for the offence under Sections 341, 323, 324, 354(D), 379, 506, 509, 34 of the Indian Penal Code and Section 12 of the POCSO Act.
3. As per the prosecution case, the allegation against the petitioner is of snatching the Dupatta of the victim.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 29.02.2024 and has clean antecedent.
5. Learned A.P.P. has vehemently opposed the
Patna High Court CR. MISC. No.29105 of 2024(3) dt.31-07-2024 2/2 prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge-cum-Special Judge, POCSO, Nalanda at Bihar Sharif/concerned Court below in connection with Chandi P.S. Case No. 574 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Chandi Police Station on the first and third Sunday of each month.
Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii). The petitioner will not stay in the village during pendency of the trial, and he will not tamper with the evidence.
