JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-11-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Phulwaria P.S. Case No. 101 of 2017 registered for the offence punishable under section 392 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on confessional statement of the coaccused. Nothing has been recovered from the possession of this petitioner. During investigation nothing has come to suggest complicity of this petitioner in the alleged crime. Petitioner has no criminal history.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period

Patna High Court Cr.Misc. No.42788 of 2017(3) dt.10-11-2017 2/2 of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XIII, Gopalganj in connection with Phulwaria P.S. Case No. 101 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
