1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 997 of 2022 registered under Sections 409/420/467/471 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused has already been allowed bail by a Bench of this Court vide order dated 06.02.2023 passed in Cr. Misc. No. 60056 of 2022
4. Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
Patna High Court CR. MISC. No.29415 of 2023(2) dt.21-07-2023 2/2 sureties of the like amount each to the satisfaction of C.J.M., Ara, Bhojpur in connection with Ara Town P.S. Case No. 997 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C. as also the conditions as follows:- (i) one of the bailors should be the family member of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall co-operate in the investigation and make himself available to the police as and when required; (iii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. shailendra/- (Arvind Srivastava, J) U T
