The petitioner apprehends his arrest in connection with Complaint Case No. 550 of 1997, Tr. No. 1771 of 2016, registered under Sections 147, 448, 323 and 380 of the Indian Penal Code. The accusation is that informant along with his brother-in-law Shankar Rawani, was present at his house. At that time, petitioner alongwith his brother Gaya Rawani and 10 to12 persons entered in the house of the informant and surrounded the Shankar Rawani, brother-in-law of the informant and Gaya Rawani pointed the pistol at the chest of Shankar Rawani. At that
Patna High Court Cr.Misc. No.14199 of 2017 (3) dt.06-07-2017 time, this petitioner snatched Rs.1,000/- and wrist watch from Shankar Rawani and also caused injury to him through fist and slaps.
Learned counsel for the petitioner submits that petitioner and co-accused, Gaya Rawani are cousin of the informant and they have falsely been implicated in this case due land dispute. It is further submitted that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Complaint Case No. 550 of 1997, Tr. No. 1771 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
