====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-08-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Bhagwanpur P.S. Case No. 3 of 2020 for the offence under sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B)a,24,35 of the Arms Act.

Learned counsel for the petitioner submits that there are two other cases pending against the petitioner. He submits that in the present case, the petitioner alongwith two others accused was apprehended by the police while they were preparing for commission of crime. From the possession of the petitioner one loaded country made pistol with live cartridge, one mobile and a bike were recovered.

Considering the fact that the petitioner has remained in custody for more than seven months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Bhagwanpur P.S. Case No. 03 of 2020.
