JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 21 of N.D.P.S. Act. Petitioner and several other accused were caught but according to the prosecution case itself, only some cash and mobile were recovered from conscious possession of the petitioner whereas Heroin is said to have been recovered from possession of other persons. Petitioner does not have any criminal antecedent which is evident from perusal of Para 3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.23879 of 2019(2) dt.15-04-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge/Special Judge, Patna in connection with Beur P.S. Case No. 416 of 2018 and Special Case No. 147 of 2018.
