KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The Petitioner is apprehending his arrest in Kartahan P.S. Case No. 40 of 2016 registered for the offence punishable under Sections 412, 413, 414, 419, 420, 467, 468, 471 and 120B of the Indian Penal Code and Section 25(1-B), A/26/35 of the Arms Act.

It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. It has been further submitted on behalf of the petitioner that the petitioner is not residing at his native village but he is residing in his Mausi house at Patna.

From perusal of the order of the lower court, it appears that the petitioner is involved in such type of crime as alleged against him in the FIR and in view of the fact that a stolen

Patna High Court Cr.Misc. No.31980 of 2017 (2) dt.13-07-2017 2/2 motorcycle and some apparatus like screw drives and duplicate keys, which are used in these type of crime has been recovered from his possession, I am not inclined to enlarge the petitioner on anticipatory bail.

Hence, the prayer for anticipatory bail of the petitioner is hereby rejected.

Let the petitioner surrender before the court below and make prayer for regular bail, which would be considered on its own merit, without being prejudiced by anything said in this order.
