JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-10-2020 Heard Ms. Shama Sinha, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Bihta P.S. Case No. 680 of 2019 registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code 1860.
The allegation against the petitioner as per the First Information Report is that he along with his other family members demanded four wheeler from the daughter of the informant (since deceased) and her family members and due to non-fulfillment of the same, she has been killed by all the accused persons.

No.26493 of 2020(2) dt.13-10-2020 2/3 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and there is general and omnibus allegation against him. Learned counsel further submits that the petitioner is grand-fatherin-law of the deceased and is about 79-80 years old. Learned counsel also submits that the petitioner is in custody since 12.02.2020 and charge sheet has already been submitted in this case.
Having heard learned counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is aged about 79-80 years and charge sheet has already been submitted in this case and there is no possibility that the petitioner will abscond and/or tamper with the evidence, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna, in connection with Bihta P.S. Case No. 680 of 2019.
