JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-01-2018 Heard learned Counsel for the petitioner, learned Counsel appearing on behalf of the informant and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Kawakole Police Station Case No. 101 of 2017, disclosing offences under Sections 341/323/307/379/504/506/34 of the Indian Penal Code.

From the First Information Report, it is apparent that some dispute arose when the informant was laying boundary around a piece of land situated in front of his house. The petitioner is said to have assaulted the informant with garasa, causing serious injuries.

Patna High Court Cr.Misc. No.46568 of 2017(4) dt.04-01-2018 2/3 submitted that case and counter case have been filed for the same occurrence on the same date, time and place. Learned Counsel appearing on behalf of the informant has vehemently opposed the prayer for anticipatory bail. Learned Counsel appearing on behalf of the petitioner has submitted that considering the nature of dispute between the informant and the petitioner, leading to registration of the two First Information Reports, if any application for grant of anticipatory bail is filed on behalf of the informant of this case, in connection with the other First Information Report, registered by the petitioner's wife, there shall be no opposition to such prayer for anticipatory bail.

Considering the stand of the petitioner and other materials on record, this application is allowed.

Let the petitioner, Satyendra Singh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Nawada, in connection with Kawakole Police Station Case No. 101 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

No.46568 of 2017(4) dt.04-01-2018 3/3 This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
