Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Magadh Medical P.S. Case No. 35 of 2020, registered for the offence punishable under Section 394 of the Indian Penal Code.

The informant is driver of Toyota Etios bearing No. BR-02PA/2665. It is alleged that on 12.02.2020 at 1.30 pm, he received a foreigner (Thai lady) from Gaya airport and proceeded towards Bodhgaya, but on the way, some criminals who were in the military dress, took away that foreigner lady in a car and snatched all the articles from her possession and dropped her at Guleria Chowk. One boy was apprehended near Varanasi with the alleged car who disclosed his name as Parminder Singh (petitioner) from whose possession, military

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on suspicion. It is further submitted that FIR is dated 15.2.2020, whereas seizure list is dated 16.2.2020. Further, the FIR has been lodged after three days of the alleged occurrence. Petitioner is in custody since 17.02.2020 having no criminal antecedent as stated in para 3 of the bail petition. Learned APP however, vehemently opposed the prayer for bail and submitted that looted articles have been recovered on the disclosure made by this petitioner and he has also been identified by the foreigner lady in the CCTV footage. Considering the facts aforesaid and the nature and severity of offence, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
