The petitioner is in custody in connection with Khagaria (Muffasil) P.S. Case No. 910 of 2018 for the offence under Section 379 of the I.P.C. and later on added 414 I.P.C. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Allegation against this petitioner is that he was involved in theft in the house of the informant. Learned counsel for the petitioner further submits that the case was registered against unknown and the name of the petitioner was surfaced on the confessional statement of coaccused Chandan Kumar. He submits that petitioner is in custody since 06.1.2019.
Considering the fact that petitioner has no criminal
Patna High Court CR. MISC. No.23186 of 2019(2) dt.10-04-2019 2/2 antecedent and he was not named in the F.I.R. and has remained in custody for nearly four months, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 910 of 2018, G.R. No. 3631 of 2018.
