====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 27-04-2023 Heard learned counsel for the petitioner and learned counsel for the State.

The present Cr. Writ Petition has been filed for quashing of F.I.R. bearing K. Hat (Sahayak) P.S. Case No. 645

Patna High Court CR. WJC No.576 of 2022(2) dt.27-04-2023 2/3 of 2021 dated 17.07.2021 lodged under Section 147, 149, 341, 342, 323, 186, 353, 332, 333, 354, 504 & 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present F.I.R. is the result of brutal action of Police with an advocate about which the C.J.M. has indicated in this matter in his order sheet which is annexed as Annexure-4. Learned counsel for the State submits that such matter requires fair investigation under supervision of some high officials.

In this regard, this Court directs the petitioner to file representation before the Chief Judicial Magistrate, Purnea and Superintendent of Police, Purnea both in the light of order passed in the case of Surendra Singh Vs. State of Bihar and others on 09.09.2022 in Cr. W.J.C. No. 153 of 2017 with analogous cases within four weeks from the date of passing of this order.

The Superintendent of Police, Purnea is directed to work under the supervision of Chief Judicial Magistrate, Purnea in the light of order passed in the case of Surendra Singh Vs. State of Bihar and others on 09.09.2022 in Cr. W.J.C. No. 153 of 2017 with analogous cases. Every action of Police and every

Patna High Court CR. WJC No.576 of 2022(2) dt.27-04-2023 3/3 decision of Police shall be subject to affirmation of the Chief Judicial Magistrate, Purnea about which observation has already been made in the said case.

Till filing of final report under Section 173 (2) of Cr.P.C. no coercive step shall be taken against the petitioner in connection with K. Hat (Sahayak) P.S. Case No. 645 of 2021. With the aforesaid direction, the present Cr. Writ Petition is hereby disposed off.
