The petitioner has prayed for bail in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 379, 411/34 of the Indian Penal Code.

Prosecution case relates to recovery of one stolen motorcycle from possession of Nitish Kumar and on interrogation he disclosed the name of three other accused persons including the petitioner who managed to escape. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The said recovery has been made from apprehended accused, namely, Nitish Kumar and on the basis of his disclosure made before the police, petitioner's name surfaced in the present case. Petitioner

Patna High Court CR. MISC. No.25027 of 2023(2) dt.23-05-2023 2/2 has no concern with the alleged motorcycle. Petitioner is languishing in judicial custody since 28.09.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge Nalanda, Biharsharif in connection with Rajgir P.S. Case No. 432 of 2021.
