ANJANA MISHRA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Bihra P.S.Case No. 117 of 2011 registered under Sections 467, 468, 471, 419, 420, 406, 409 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is the agent of the project of MNREGA Scheme No.12 of 2008-09 in Sattarkatya Block in the district of Saharsa. The allegation against the petitioner is that on account of his laches payment could not be made under the said scheme. Learned counsel further submits that the money, which has been paid to the recipient, is being paid directly by the Post Office and the
Patna High Court Cr.Misc. No.30039 of 2015 (3) dt.14-10-2015 petitioner being an agent has no role to play, rather he is only responsible for getting the work done.
Considering the aforementioned facts and circumstances and there is no further material so as to implicate the petitioner in the present case, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Bihra P.S.Case No. 117 of 2011 to the satisfaction of the Chief Judicial Magistrate, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
