The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and section 7 of the Essential Commodities Act.
As per the prosecution case, petitioner is suspected to be involved in black-marketing of government subsidized food grains. It is further alleged that 237 bags of rice and 41 bags of wheat was found in the shop of petitioner.
It is submitted that petitioner has been falsely implicated in this case. Petitioner is neither PDS dealer nor
Patna High Court CR. MISC. No.25741 of 2022(2) dt.13-09-2022 2/2 agent. Petitioner is a free sale dealer of wheat and rice for which no license is required and he is running his proprietorship business firm at Sanghat Chawk Madhepur, Madhubani and is having GST No. 10APTPN4473NIZB.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 260 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
