The petitioners apprehend arrest in connection with Kako Police Station Case No. 211 of 2017 registered for the offences under sections 341, 323, 504, 379, 307/34 of the Indian Penal Code.
It has been submitted that the present case has been lodged to count the case of the petitioners which has been filed by petitioner no. 4. On the date of occurrence, the informant and her
Patna High Court Cr.Misc. No.14667 of 2018 (3) dt.05-04-2018 2/3 family members came and assaulted the wife of petitioner no. 4. The wife of petitioner no. 4 sustained injury and was referred to Patna Medical College Hospital where she remained for six days. The informant has lodged the present case only to save her skin from the said offence. The allegation of assault is omnibus and no one sustained any injury in the said occurrence. The learned Additional Public Prosecutor on the other hand, opposed the submission.
Considering the nature of allegation, case and counter case between the parties, the prayer of anticipatory bail is allowed and the above named petitioners in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Judge-IV, Jehanabad in connection with Kako Police Station Case No. 211 of 2017, subject to conditions as laid down under section 438(2) Cr.P.C. Further condition is that (1) one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
