The prayer for bail of the petitioner has already been refused on 02.08.2018 vide order passed in Cr. Misc. No. 33423 of 2018.

Learned counsel appearing for the petitioner submits that the petitioner is in custody since 29.08.2017 and the trial of the petitioner has not been concluded yet.

Report regarding stage of the trial has been received through Letter No. 110, dated 31.05.2019, from the Court of the Additional Sessions Judge, XI, East Champaran at Motihari, which shows that the charge has already been framed against the petitioner on 27.03.2019, the summons have been issued to the nine witnesses and the trial is expected to be concluded within a period of fifteen months.

Patna High Court CR. MISC. No.26249 of 2019(3) dt.03-07-2019 2/2 I do not find a reason to reconsider the prayer for bail, hence, it is rejected.

However, the Additional Sessions Judge, XI, East Champaran at Motihari, is directed to conclude the trial within one year by taking all effective steps.

If the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail.
