JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2020 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner seeks bail in Guthani Police Station Case No. 26 of 2020 (Sessions Trial No. 156 of 2020) registered for the offences punishable under sections 341, 392 and 34 of the Indian Penal Code.
The informant alleges that on 24.1.2020 at 8.35 pm when he had gone to the shop for purchasing furniture, unknown miscreants suddenly surrounded him, assaulted on the point of pistol and snatched mobile phone, cash Rs. 7080/- and the pickup van.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has not been put on test identification parade
Patna High Court CR. MISC. No.26600 of 2020(3) dt.23-11-2020 2/2 (TIP) till date. It is stated in paragraph 3 of the bail petition that the petitioner has got no criminal antecedent. He is in custody since 31.1.2020.
Learned counsel for the State opposes the prayer for bail and submits that the looted articles have been recovered from the possession of the petitioner.
In view of the nature as well as the gravity of the offence alleged in the FIR, prayer for bail of the petitioner is refused.
