The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 363 and 366 (A)/34 of the Indian Penal Code.
Allegation has been made for kidnapping the victim girl who is claiming to be 16 years. Statement of the victim girl under Section 164 of the Code of Criminal Procedure has been produced in which age has been mentioned as 19 years. She has stated that she has entered into marriage and she is living in her Sasural.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today,
Patna High Court Cr.Misc. No.19632 of 2017 (2) dt.06-07-2017 let petitioner, namely, Vishwakarma Sah, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- XIV, Gopalganj in connection with Barauli P.S. Case No. 6 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
Certified copy of statement of the victim under Section 164 of the Code of Criminal Procedure be kept on record for future reference.
