The petitioners seek bail in a case registered for the offence punishable under Sections 302 & 201/34 of the Indian Penal Code.
The prosecution case, in brief, is that the granddaughter

No.26424 of 2020(4) dt.15-01-2021 2/3 (Natini) of the informant called the informant and told him that the petitioners have murdered the daughter of the informant by hanging her and threw the dead body in the chaur. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. They have been falsely implicated in the case due to dirty village politics. No overt act has been attributed to the petitioners. It is further submitted that the parties to the case have compromised the matter outside the Court and a compromise petition has been filed before the learned Court below. Petitioner Manish Sahni is languishing in custody since 01.03.2020, while petitioner Vinod Sahani is languishing in custody since 01.05.2020.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail, after framing of charge, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No.
(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife.

(2) The petitioners shall not indulge himself in any similar offence till conclusion of the trial.
(3) The petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioner shall co-operate with the investigation, if not already concluded and make himself available and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Anjani Kumar Sharan, J) Trivedi/- U T
