Apprehending his arrest in Beur P.S. Case No. 19 of 2017 registered under section 498-A, the petitioner, who is said to be the husband of the informant, prays for grant of anticipatory bail.
It has been pointed out from the prosecution case itself that the informant left the matrimonial home only few days after the marriage on 02.06.2013. In the meanwhile, she also filed a complaint case on 04.04.2014. Considering the matrimonial discord between him and his wife, the petitioner filed a divorce
Patna High Court Cr.Misc. No.24450 of 2017 (3) dt.06-07-2017 2/2 petition (Annexure-2) on 11.06.2014 whereafter the present FIR has been filed on 12.01.2017. He points out from the impugned order that in spite of notice she did not appear before the learned court below. For securing the privilege of anticipatory bail, the petitioner is ready and willing to pay a consolidated amount in favour of the informant, as directed by the court. Considering the above submissions, the petitioner named above, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM-cum-Sub Judge-VIII, Patna in Beur P.S. Case No. 19 of 2017 on condition that one of the bailors shall be his own/close family member.
Along with the bail bonds the petitioner shall produce evidence/receipt showing payment/deposit of Rs. 4000/- favouring the informant. It will also be open to the petitioner to enclose a demand draft of the said amount favouring the informant along with the bail bonds.
