JUSTICE RAVI RANJAN ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 409 and 420 of the Indian Penal Code.
It is submitted that the petitioner was not the Panchayat Secretary of the concerned Gram Panchayat but on account of the fact that the previous Panchayat Secretary met with an accident, he was given additional charge of the concerned Gram Panchayat and since charge of such document was never given to him, he had not been able to furnish the same.
Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Kaushal Kumar @ Kaushal Kishore, be released on bail in the event of arrest/surrender before
Patna High Court Cr.Misc. No.29561 of 2016 (2) dt.29-08-2016 the court below within a period of six weeks from today in Deoriya Police Station Case No. 15/2016 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Aditya Kumar Singh, Judicial Magistrate, Ist Class, Muzaffarpur, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
