JUSTICE SANJAY PRIYA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Hajipur Town P.S. Case No. 491 of 2016 initiated for the offence under Sections379, 308 & other minor sections of the Indian Penal Code. As per written report, there is specific allegation against this petitioner of assaulting the informant with iron rod. The C.D. has been received whrein the doctor has found three injuries on the person of injured. The nature of injury No. 2 was opined by the doctor to be grievous. The opinion regarding one injury was kept reserved.

From the injury report, it appears that there was repetition of blows.

In such circumstances, this court is not inclined to grant

Patna High Court Cr.Misc. No.23071 of 2017 (3) dt.06-07-2017 2/2 anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail, which will be considered on its own merit without being prejudiced by this order.
