The petitioner, who is husband of opposite party no.2, apprehends his arrest in a case registered for the offence under Section 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.
The complainant alleged that the accused persons tortured her for dowry.
The petitioner denies the allegation and submits that he is willing to keep the complainant with full care and affection, but she is not willing to stay with him. He submits that the allegations are general in nature.
Having regard to the facts of the case, I am not
Patna High Court Cr.Misc. No.15247 of 2017 (4) dt.06-07-2017 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail is rejected. However, if the petitioner surrenders before the court below (Sub-Divisional Judicial Magistrate, Buxar) in connection with Complaint Case No. 1114 C of 2013 and prays for regular bail, the same would be disposed of on the same day without being prejudiced by this order.
