The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 504, 506, 308, 354 and 435/34 of the Indian Penal Code pending in the learned court below.
As per the prosecution case, the petitioners caused lathi and rod blow injuries to the informant, her family members. It is further stated that the petitioners disrobed the
Patna High Court CR. MISC. No.25078 of 2023(2) dt.11-07-2023 2/3 informant with intention to outrage her modesty. It is further stated that earlier to his resident, the petitioners set straw of the informant on fire.
Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He further submits that there is general and omnibus allegation against the petitioners. He submits that there is case and counter case between the parties and both sides have sustained injuries. He further submits that the injuries found upon the victims are simple in nature. He further submits that petitioner no.1 & 2 have got one criminal antecedent and rest of the petitioners have got no criminal antecedent as stated in para3 of the bail application. Learned APP for the State opposes for prayer for bail.
Considering the aforesaid facts and circumstances and the fact that nature of the injury is simple in nature, let the petitioners, named above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bonds of Rs.
