JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-03-2016 At the outset, Mr. Anil Kumar, Assistant Counsel to Standing Counsel No.10, submits that on completion of investigation, the police have found the case to be of civil nature and, hence, a report has been submitted under section 173(2) of the Code of Criminal Procedure before the court of jurisdictional Magistrate wherein the petitioner has not been sent up for trial. Having come to know about the outcome of the investigation of the police case, Mr. Ansul, learned counsel for the petitioner, seeks leave to withdraw the present application.
