ANJANA MISHRA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the Bihar State Food and Civil Supplies Corporation as well as learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that at all material times, the petitioner has been willing to settle whatever dues fall against him and has been repeatedly representing to the Bihar State Food and Civil Supplies Corporation to sit across the

Patna High Court Cr.Misc. No.32272 of 2016 (7) dt.17-01-2017 P2/3 table and calculate the dues so that he can make the entire dues cleared whatever stands against him.

Learned counsel for the Bihar State Food and Civil Supplies Corporation submits that in Annexure-6/2, the petitioner has admitted that he will clear the dues.

In view of such facts and circumstances and that the petitioner is willing to sit across the table and pay back the dues of the Bihar State Food and Civil Supplies Corporation after the necessary verification, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Sessions Judge, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 355 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. It is made clear that the petitioner shall not evade, but will approach the Managing Director, Bihar State Food and Civil Supplies Corporation at Patna for early disposal of his application for settlement of the dues.

It is made clear that if the petitioner does not co-operate and participate in the settlement proceeding, it shall be open to the
