JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Sarairanjan P.S. Case No. 206 of 2017 for the offences punishable under sections 419, 420, 468 and 471 of the I.P.C.

Allegedly, the petitioners after forging thumb impression of the complainant-informant obtained compensation amount from the Land Acquisition Office, Samastipur for the land of Khata No. 30, Khesra No. 2448/1593, area 3 decimals which was acquired by the Government of Bihar from the complainantinformant.

Patna High Court Cr.Misc. No.8008 of 2018 (2) dt.17-02-2018 2/2 Submission is of false implication and that the aforesaid land was of the petitioners but to avoid complicity the petitioners want to pay Rs. 32,000/- in two installments to the informant-complainant.

The learned A.P.P. fairly submits that if the petitioners pay the amount of Rs. 32,000/- to the informant then sympathetic view can be taken.

In the facts and circumstances stated above, the petitioners in case pay Rs. 32,000/- in two monthly equal installments to the informant in the court then after payment of first installment of Rs. 16,000/- the petitioners shall be released on provisional anticipatory bail on execution of bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. 6th, Samastipur in connection with the aforementioned case and after payment of second installment further Rs. 16,000/- to the informant the provisional anticipatory bail granted to the petitioners shall be confirmed by the learned court below itself.

Accordingly, this Criminal Miscellaneous is hereby disposed of.
