JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Risiup P.S. Case No. 73 of 2017 dated 16.10.2017 instituted for the offences under Sections 323, 324, 379, 341, 308, 34 of the Indian Penal Code. The petitioners and others are said to have dragged the informant out of the bus in which he was a Conductor and assaulted.

The learned counsel for the petitioners has submitted that there was some dispute in the past with respect to the purchase of tickets; hence a false case has been instituted. The falsity of the allegation, it has been argued, appears on face of it. Many persons are said to have assaulted the informant but he has received injuries in the nature of

Patna High Court Cr.Misc. No.16092 of 2018 (2) dt.09-04-2018 2/2 bruises and abrasions only. One of the accused persons has been granted anticipatory bail by a Bench of this Court vide order dated 06.04.2018 passed in Cr. Misc. No. 17103 of 2018.

The petitioners do not have any criminal antecedent. Regard being had to the nature of accusation against the petitioners, the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, are directed be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIII, Aurangabad in connection with Risiup P.S. Case No. 73 of 2017.
