The petitioner apprehends his arrest in connection with Jandaha Police Station Case No.20 of 2016 registered under Sections 302 and 201/34 of the Indian Penal Code pending in the court of the Chief Judicial Magistrate, Vaishali at Hajipur. The accusation against the petitioner and others is of killing the sister of the informant by pouring kerosene oil on her body and set her on fire.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the sister of the informant and due to misconception, the informant has lodged this
Patna High Court Cr.Misc. No.30227 of 2016 (3) dt.20-08-2016 2/2 false case. In fact, the deceased, the sister of the informant, sustained burn injury in course of cooking food and died later on. It is further submitted that the informant on knowing the real fact has filed an application in the court of the Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected.
