1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 379 of the Indian Penal Code.

3. Petitioner was seen wandering near the vehicle which was stolen by the accused persons.

4. Learned counsel for the petitioner submits that the petitioner has been made accused in this case only on suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. Similarly situated coaccused person namely, Manu Yadav has been granted bail by the coordinate Bench of this Court vide order dated 14.02.2020 passed in Cr. Misc. No. 76843 of 2019. Petitioner has got clean

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XIII, Saran at Chapra in connection with Manjhi P.S. Case No. 179 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
