2. In this case, the petitioner is seeking regular bail in connection with Ara Mahila P.S. Case No. 04 of 2024, registered for the offences punishable under Sections 376, 341, 323, 504 and 506 of the IPC.

The informant lodged an FIR alleging that after her divorce in 2019, she met the petitioner who promised to marry her and engaged in sexual relationship with him, resulting in her pregnancy and birth of a child. On the pretext of marriage, the petitioner took her to Gujarat and sexually exploited her. Thereafter, the petitioner left her and solemnized

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. The mother of the petitioner is own sister of the victim. There was dispute between father of the petitioner and mother of the petitioner since his mother has solemnized second marriage to someone else and she also transferred her properties in favour of her second husband. The father of the petitioner was aggrieved due to action of his mother and he has filed a civil suit which was decreed in his favour and mother of the petitioner filed a title appeal against that judgment and decree.

The further submission is that the petitioner was taking favour of his father against his mother and it was the reason that the mother of the petitioner instigated her sister to lodge false case against the petitioner. The fact is that petitioner is a married person. His legally wedded wife is Rehana Khatoon and this case is nothing but false implication due to enmity between father and mother of the petitioner.
6. Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of
Patna High Court CR. MISC. No.28385 of 2024(3) dt.01-08-2024 3/3 Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SDJM, Ara in connection with Ara Mahila P.S. Case No. 04 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
