NILU AGRAWAL ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Halsi P.S. Case No.117 of 2015 for the offences alleged under Sections 447, 341, 323, 504, 506 and 354 of the Indian Penal Code.

The prosecution case is that the informant gave a written report before the officer-in-charge of Halsi Police Station stating therein that 10 days ago Ramji Das, Laxman Das, Rita Devi and Bittu Devi were abusing the informant and her daughter-in-law and on protest they assaulted. In the meanwhile, Ramji Das pushed the informant. She fell down. Thereafter, Ramji Das assaulted by feet on the chest of informant causing fractured wound on her chest. Villagers intervened the matter. In the evening she went to the hospital with her husband for treatment.

Patna High Court Cr.Misc. No.51554 of 2015 (2) dt.10-12-2015 Panchayati was held but accused persons did not agree with the Panchayat.

It has been submitted by learned counsel for the petitioner that he has a clean antecedent, as is evident from paragraph No.3 of the petition. It has further been submitted that the petitioner is innocent and has falsely been implicated in the aforesaid case and that the petitioner and the informant are co-villagers and a counter case has been filed by the co-accused Rita Devi bearing Complaint Case No.652-C/2015 against the informant and her family members.

Be that as it may let the petitioner, namely, Ramji Das, in the event of his arrest/surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each in connection with Halsi P.S. Case No.117 of 2015 to the satisfaction of learned Judicial Magistrate, Ist Class, Lakhisarai, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
