JUSTICE BIRENDRA KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code. The petitioners, allegedly, caused injury at the head of the informant and Chhotelal Yadav.
The impugned order reveals that the Doctor has found simple injury.
Since the petitioners had knowledge that their act might cause death, I am not inclined to grant anticipatory bail to the petitioners in connection with Manjhi Police Station Case No.
Patna High Court Cr.Misc. No.24493 of 2017 (3) dt.06-07-2017 2/2 216 of 2016 pending in the Court of learned 5th Additional Chief Judicial Magistrate, Saran, Chapra.
Hence, prayer for bail is rejected.
In the event of surrender of the petitioners, the court below shall dispose of their prayer for regular bail without being prejudiced by this order and considering the fact that there is no allegation of repetition of blow.
