JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 06-07-2017 Heard learned counsel for the petitioner. Despite repeated calls, nobody appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with Shahzahanpur P.S. Case No. 40 of 2003 registered for the offences punishable under Sections 147, 148, 341, 342, 353, 337 and 427 of the Indian Penal Code and Sections 150, 152, 153, 154, 146 and 174 of the Indian Railway Act.
Regard being had to the fact that on completion of investigation, the police found the accusation against the petitioner to be false, but the learned Magistrate took cognizance of the offence differing with the police report, the petitioner

No.21256 of 2017 (3) dt.06-07-2017 2 / 2 named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with Shahzahanpur P.S. Case No. 40 of 2003 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
