The petitioner seeks pre-arrest bail in connection with Shahzahanpur P.S. Case No. 40 of 2003 registered for the offences punishable under Sections 147, 148, 341, 342, 353, 337 and 427 of the Indian Penal Code and Sections 150, 152, 153, 154, 146 and 174 of the Indian Railway Act.

Regard being had to the fact that on completion of investigation, the police found the accusation against the petitioner to be false, but the learned Magistrate took cognizance of the offence differing with the police report, the petitioner

Case No. 40 of 2003 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
