The petitioner has prayed for bail in a case registered for the offence punishable under sections 364(A) of the Indian Penal Code.
As per allegation in the FIR, a ransom call from mobile numbers, 7463910823 and 9193745911 has been received by the informant to bring Rs. 15,00,000 at Mora talab otherwise her husband will be killed and thereafter mobile phone of her husband and mobile phone of the accused are getting switched off.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. Informant's husband was recovered from the
Patna High Court CR. MISC. No.25065 of 2023(2) dt.22-05-2023 2/2 house of Shankar Kumar. On the confessional statement of the victim, petitioner was arrested. Similarly situated other accused person, namely, Ramchandra Verma has already been enlarged on bail by lower court. Petitioner has no criminal antecedent and he is languishing in judicial custody since 6.1.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 05 of 2022.
