The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420, 406, 467, 468 and 471 of the Indian Penal Code.

It is contended on behalf of the petitioner that he was Branch Manager of the Canara Bank, Barharia Branch of Siwan District. According to allegation set out in the first information report co-accused Firoj Alam has fraudulently, through cheque book issued to him, had withdrawn Rupees three lacs from the account of the informant, who happens to be the N.R.I. Learned counsel for the petitioner submits that the moment fraud came to the notice of the Bank, the Senior

It is further contended that subsequently the amount has already been credited in the account of the account holder and who has withdrawn the money also which would be apparent from Annexure 3/a.

Having regard to the facts and circumstances of the case, let petitioner Sachidanand Prabhat be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Barharia P.S. Case No. 209/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, VI, Siwan subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
