JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-12-2020 Heard Mr. Raj Kishore Prasad, learned counsel for the petitioner and Mr. Yogendra Kumar Singh, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Sarmera P.S. Case No. 72 of 2019 (GR No. 2394 of 2019 ) registered for the offence under Sections 302 / 34 of the I.P.C. and Section 27 of the Arms Act.

The allegation as per the First Information Report is that the petitioner along with 09 accused persons dragged the son of the informant in a ditch and shot him dead. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged and the allegation against the accused persons are general and omnibus in nature

Patna High Court CR. MISC. No.26590 of 2020(4) dt.04-12-2020 2/2 including the petitioner. Learned counsel further submit that the co-accused persons namely, Rajo Yadav and Rakesh Yadav, who are similarly situated to the petitioner have been granted bail by this court in Cr. Misc. No. 85081 of 2019 and the petitioner is in custody since 07.09.2019.

Having heard learned counsel for the parties and taking into consideration the materials available on record, the fact that similarly situated co-accused persons have been granted bail by this court and the petitioner is in custody since 07.09.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate , Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 72 of 2019 ( GR No. 2394 of 2019 ).

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
