Petitioner apprehends his arrest in connection with Khagaria (Chitragupta Nagar) P.S. Case No.793 of 2020, registered for the offences punishable under Sections 341, 498(A), 506 and 34 of the Indian Penal Code.
The petitioner along with other in-laws are said to have not allowed the informant to live in her matrimonial home. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no specific allegation against the petitioner. The petitioner has got no criminal antecedent. It is also submitted that in fact the
Patna High Court CR. MISC. No.34454 of 2021(3) dt.13-05-2022 2/2 petitioner has not solemnized marriage with opposite party no.2. Learned counsel for O.P. No.2 submits that O.P. No.2 has solemnized marriage with the petitioner but her in-laws and husband do not allow her to live in her matrimonial home. Taking into consideration the facts aforesaid, both parties are directed to appear before the learned court below on 30.05.2022.
The learned court below is directed to enlarge the petitioner on provisional bail on its own satisfaction in connection with Khagaria (Chitragupta Nagar) P.S. Case No.793 of 2020 for a period of six months and shall try to resolve the dispute between the parties. If the learned court below finds after six months that the dispute between the parties has been settled, the provisional bail granted to the petitioner shall be confirmed only thereafter.
