The petitioner apprehends his arrest in Kurtha P.S. Case No. 203/2016, registered for the offences punishable under Sections 419, 420 and other sections of the Indian Penal Code. The informant alleged that one Rahul Vishwakarma got appointment on different panchayats on the forged certificates. It is alleged that Mukhiya and Panchayat Secretary also appeared to be guilty, as they did not verify the certificates of Rahul Vishwakarma.
Learned counsel for the petitioner submits that the petitioner is Panchayat Secretary of Gram Panchayat Kurtha. According to the circular, the Block Education Officer is
Patna High Court Cr.Misc. No.18121 of 2017 (3) dt.06-07-2017 2/2 authorized to verify the genuineness of the certificates of candidates found fit for appointment to the post of teacher. The petitioner has nothing to do with the verification of certificates. It appears that petitioner is simply a Panchayat Secretary and he only keeps the records of the Panchayat. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 203/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
