ANJANA MISHRA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehending his arrest in connection with Sarai P.S. Case No. 157 of 2014 registered for the offences punishable under Sections 448, 341, 323, 308, 379, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though there is allegation that the petitioner assaulted with iron rod on the head and lips of the informant but only one lacerated wound has been found on the upper lip of the informant which is simple in nature.
Considering the nature of allegation made and the fact that the petitioner got fair and clean antecedent, let the petitioner above named, in the event of his arrest or surrender
Patna High Court Cr.Misc. No.32730 of 2016 (2) dt.11-08-2016 2/2 before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class-cumAdditional Munsif, Vaishali at Hajipur in connection with Sarai P.S. Case No. 157 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
