12-02-2018 Heard Dr. Manoj Kumar, learned counsel for the petitioners and Sri Nagendra Prasad, learned Addl. Public Prosecutor.

Three petitioners, apprehending their arrest in Lodipur P.S. Case No. 189 of 2017 registered for offence under Sections 447, 341, 323, 307, 34 of the Indian Penal Code and Section 27 Arms Act, 1959, have prayed for grant of bail in the event of their arrest or surrender.

Learned counsel for petitioners, by way of referring to F.I.R., submits that only allegation against petitioners is that they were indulged in stone pelting. Besides this, there is no allegation.

Patna High Court Cr.Misc. No.7006 of 2018(2) dt.12-02-2018 2/2 I have also examined the material on record, particularly the F.I.R. and after going through the same, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let aforesaid six petitioners namely 1. Sushil Yadav, 2. Prakash Yadav and 3. Amit Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IV, Bhagalpur in connection with Lodipur P.S. Case No. 189 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
